In accordance with Law 20/2014 of October 16, regulating electronic contracting and operators conducting economic activity in a digital space, we inform you that you have accessed a website (hereinafter, 'the Website') whose domain name (https://www.breemfy.com) is owned by the Andorran company Hubting S.L. (hereinafter, 'BREEMFY'), duly registered in the Register of Companies of the Government of Andorra with number 24890 and NRT L-719964-D. Its registered office is located at Avda. Carlemany 115, 6th floor, AD700 Escaldes-Engordany (Principality of Andorra).

The purpose of the Website is to inform about the services of the intermediation platform offered by BREEMFY (hereinafter, 'the Platform').

For any inquiries or claims regarding the Platform, BREEMFY provides a contact form available on the Website.

# Acceptance of the Website Terms and Conditions of Use

Access to the Website implies full acceptance by its users of these terms and conditions, as well as the privacy policy and the cookie policy, all of which are also available on the Website (hereinafter, collectively, 'the Terms and Conditions').

Likewise, users of the Website agree to use it and its contents diligently, in accordance with current legislation, as well as with good faith and good customs, and without contravening morality or public order.

Therefore, among others, access to or use of the Website for illegal purposes is not permitted, including but not limited to the following prohibitions:

  • Use of the Website in a way that may cause damage, interruptions, inefficiencies, or defects in its operation;
  • Use of the Website to transmit, install, or publish any virus, malicious code, or other harmful programs or files;
  • Use of the Website to collect personal data from other users without authorization;
  • Unauthorized access to networks or information systems connected to the Website, through hacking, password extraction, or any other illegal means;
  • Breaking or attempting to break the security or authentication measures of the Website or any network or information system connected to it, or the security or protection measures inherent to the Website's content;
  • Carrying out any action that causes a disproportionate or unnecessary overload on the infrastructure of the Website or on the networks or information systems connected to it.

# Right to Modify and Update the Website Terms and Conditions of Use

BREEMFY reserves the right to make, without prior notice, at any time and with immediate effect, any modifications and periodic updates it deems appropriate to the Terms and Conditions. Therefore, BREEMFY recommends that users of the Website review the Terms and Conditions periodically.

# Rights and Legal Positions over the Contents of the Website

Definition of the term 'contents':

For the purposes of the Terms and Conditions, the term 'contents' refers to all the elements that make up the Website, including but not limited to the source code, the design and navigation structure of the Website, as well as distinctive signs, videos, photographs, illustrations, graphics, texts, data, and other displayed information.

Rights and legal positions over the contents:

The contents are subject to intellectual property rights, industrial property rights, image rights and/or other rights or legal positions of economic analysis owned by BREEMFY or third parties who have granted the relevant licenses or authorizations. Therefore, access to the Website does not grant users any ownership or right of use over the contents (including, among others, reproduction, distribution, public communication, making available or transformation), unless authorized by BREEMFY or the respective rights holders, either expressly on the Website or through prior written licenses or authorizations.

Therefore, BREEMFY reserves the right to use watermarks, technological devices or other security means that allow tracking or online monitoring of unauthorized uses of the contents. In any case, BREEMFY reserves the right to take appropriate civil or criminal legal action against users of the Website who infringe intellectual property rights, industrial property rights, image rights, or other legal or economic rights over the contents.

If any user considers that any content infringes the rights or legal positions of third parties, they must immediately notify BREEMFY using the contact or claim methods indicated in the 'Ownership and Purpose of the Website' section so that the company can analyze and assess the situation.

# Right of Exclusion from the Website

BREEMFY reserves the right to deny or suspend, without prior notice and at its sole discretion, at any time and either permanently or temporarily, access to the Website to users who violate the Terms and Conditions. This right of BREEMFY is without prejudice to any potential civil or criminal legal actions it may take against the respective users.

# Liability

1. User Liability

Users will be solely responsible for taking appropriate measures to protect the devices and software through which they access the Website from, among others, viruses, malicious code, or other harmful programs or files.

Users will be solely responsible for the use they make of the contents provided through the Website.

If users make inquiries or claims to BREEMFY using the methods provided in the 'Ownership and Purpose of the Website' section, they will be liable for any damages caused to the company or third parties for providing false or inaccurate data or information.

Users will also be responsible in all other cases where they violate the Terms and Conditions, such as, among others, the cases indicated in the 'Acceptance of the Website Terms and Conditions of Use' section.

2. BREEMFY Liability

BREEMFY shall not be liable for damages or other consequences arising from users' use of the Website or its contents.

BREEMFY shall not be liable for damages or consequences resulting from the unavailability of the Website or its contents due to technical, security, control, update or maintenance reasons, or due to errors from servers or third-party intermediaries or providers, such as telephone line failures or internet overloads.

BREEMFY shall not be liable for damages caused to users of the Website by malicious software, cybercriminal actions, or other illegal intrusions by third parties.

BREEMFY does not control the services, content, and/or other elements accessible through technical links, directories, or other means available on the Website (such as Facebook, Instagram, TikTok, X, LinkedIn, and similar). Therefore, it is not responsible for their availability, quality, or accuracy, nor for any resulting damage. The existence of such access does not imply any agreement, recommendation, promotion, or identification by BREEMFY.

Users who choose to visit and/or use any third-party links do so at their own risk and must take appropriate protective measures.

Without prejudice to the above, if any user believes that a link or directory accessed through the Website infringes third-party rights, they must notify BREEMFY immediately using the contact or claim methods indicated in the 'Ownership and Purpose of the Website' section so that the company can evaluate the situation.

BREEMFY may temporarily or permanently interrupt access to the Website if it cannot or simply does not wish to continue operating it. In such cases, user access will be immediately terminated, and no liability may be claimed against BREEMFY.

BREEMFY also reserves the right, at any time and without prior notice to users, to modify any Website content, or to update or correct errors or inaccuracies, without incurring liability.

Unless otherwise provided by applicable law, if BREEMFY is eventually held liable for damages to Website users, its liability will be limited to actual, real, and specific damages.

Notwithstanding the foregoing, BREEMFY will not be liable under any circumstances for damages or other consequences resulting from users' breach of the Terms and Conditions.

# Applicable Law and Jurisdiction for the Terms and Conditions

The Terms and Conditions shall be governed by Andorran law.

Users of the Website submit to the jurisdiction of Andorra, expressly waiving any other jurisdiction that may correspond to them by law.

The foregoing is without prejudice to the fact that, due to a user's status as a consumer, other legislation and/or jurisdiction may apply by legal mandate.
